What is an EIN?

A Federal Employer Identification Number (FEIN or EIN) is a number assigned to businesses by the IRS for federal tax purposes. An EIN is essentially the equivalent of a social security number for your business, and you can obtain an EIN by filing Form SS-4 with the IRS.

Do I Need an EIN?

Not every Florida business entity will need an EIN. The IRS provides a list of various reasons for why you will need an EIN.

You must obtain an EIN if:

  • You formed a Florida corporation or partnership
  • Your business has employees
  • Your business must file Employment, Excise, or Alcohol/Tobacco/Firearms tax returns
  • Your business withholds taxes on income (other than wages) paid to a non-resident alien
  • You have a Keogh plan
  • You are involved with a trust, estate, real estate mortgage investment conduit, non-profit, farmers co-op, or plan administrators

If you have a Florida LLC and your company does not fall into any of the above categories, then you are not required to file for an EIN (unless your bank requires an EIN to open a business account).
